Procedures for Bidding with Bangkok Art Auction Center Company Limited

1. Bidding procedures:                
        1.1 Live bidding
        1.2 Absentee bidding
        1.3 Telephone bidding
2. Only the auctioneer may state each bid. There is no restriction on the increment of each bid.
3. The successful bidder is the person who has offered the highest bid when the auctioneer brings down the hammer and will have the rights to the lot(s).

1. Registration for Bidding

      1.1 Those who are interested in participating in the auction can register via:
  Self-registration at RCB Galleria I, 2nd Floor, River City Bangkok
  Date: December 8th – 17th                   Time: 11.00 – 19.00.

      1.2 Self-registration at RCB Auctions 4th Floor, River City Bangkok
  Date: December 18th                            Time: 11.00 – 13.00.
  1. To arrange absentee bidding, you can find documents and submit an offer in advance via: RCB Galleria I, 2nd Floor,                                   
  River City Bangkok from December 8th – 17th, 2021 at 11.00 – 19.00.

2. Documents required for registration: 
     2.1  Copy of ID card or copy of passport (for foreigners)
     2.2 Evidence of payment for public utilities or credit cards, etc. to confirm your identity and address   
     2.3  Bank statement showing the balance of your bank account matching the highest total value of your intended bids.

      2.4   Make a deposit to express your intention to participate in the auction via:
               1) Cash
               2) Bank : transfer to Bangkok Art Auction Center Company Limited
                               Siam Commercial Bank Talad Noi Branch

               3) Cheque : payable to Bangkok Art Auction Center Company Limited
               4) Visa or Master Card on 18 December 2021 only.

For the deposit made by cash or bank transfer and cheque, the company will return the amount to the bidders by December 30th, 2021 after deducting the value of the successful bidder’s lots (if any).

The deposit made by credit cards will be cancelled at the end of the event if the bidders win nothing. If yes, the value of the successful bidder’s lot(s) and the bidding fee will be deducted from the deposit amount before cancelling the rest. However, if the price of the bidder’s lot(s) is not paid on the day of the auction, the company will consider the deposit amount after deducting 3% credit card fee as the partial payment of the bidder’s lot(s) according to the payment condition No. 2.

The company reserves the right to change the highest total value of your intended bid by 13.00 on December 18th, 2021.

Registration will be completed after the company receives all the required documents and the confirmation will be informed.

Payment​

For live bidding (when bidders physically appear at an auction hosted by an auctioneer), telephone bidding and absentee bidding, the successful bidder is required to pay a bidding commission of 15% (plus Vat 7%) in addition to the hammer price. The payment can be made by:

  1.   Cash
  2.   Bank transfer

  3.   Credit card : Payment via Master Card and Visa only.
                  Credit card payments are subject to a 3% surcharge following the bank’s regulations. The payment with Visa and Mastercard credit cards is accepted on December 18th, 2021 only
  4.   Cheques
                  Payable to: Bangkok Art Auction Center Company Limited
                  Payment will be complete only when 100% of the amount has been paid within a period of 5 business days.

                       – If 100% of the amount cannot be collected within the designated period, the company reserves the right to offer the auctioned lot(s) to the next highest bidder, as agreed between the next highest bidder, the owner of the auctioned lot(s) and the company.
                       – The successful bidder must make the payment and collect the lot(s) within 5 business days, after the payment is completed. If the successful bidder cannot collect the lot(s) in question within the designated period, the company reserves the right to charge a maintenance fee of 1,000 Baht per day per piece of each lot.
                       – If the successful bidder completes the payment but fails to contact the company to collect the lot(s) within 3 months of the auction day, the lot(s) in question will fall under the ownership of the company.
                       – Deposits will be kept by Bangkok Art Auction Center in case of withdrawal of intention to pay the remaining balance within 5 business days.

Transportation

                       – The successful bidder will be responsible for the packaging and transportation of their lot(s) out of the company’s office. We will provide details of a shipping company for your convenience without any responsibility for this matter.
                       – To ship lot(s) abroad, the successful bidder will be responsible for following the procedures, rules, and regulations of the government concerning the shipment of items out of the country.

เงื่อนไขการเข้าร่วมการประมูล​

ระเบียบการเข้าร่วมประมูลกับบริษัท บางกอก อาร์ต อ๊อกชั่น เซ็นเตอร์ จำกัด

​     1. การเข้าร่วมประมูลทำได้ ดังนี้
​    ​     1.1 ผู้ประมูลเข้าร่วมประมูลด้วยตนเอง
​    ​     1.2 การฝากประมูลล่วงหน้า
​    ​     1.3 การประมูลผ่านทางโทรศัพท์
​     2. พิธีกรการประมูลจะเป็นผู้ขานราคาประมูลแต่ละครั้ง การขานเพิ่มราคาประมูลให้กระทำได้โดยอิสระ
​     3. ผู้ชนะการประมูล คือ ผู้ได้สิทธิ์ในทรัพย์ประมูล ภายใต้เงื่อนไขที่ว่า ผู้ชนะการประมูล คือ ผู้ที่เสนอราคาสูงสุด ณ สถานที่ประมูล ซึ่งพิธีกรได้ขานรับและเคาะไม้

​    ​     2.1 สำเนาบัตรประชาชนหรือสำเนาพาสปอร์ต สำหรับชาวต่างชาติ
​    ​     2.2 เอกสารสำหรับค่าใช้จ่ายที่มีการจ่ายค่าสาธารณูปโภค การชำระบัตรเครดิต และอื่น ๆ เพื่อยืนยันตัวตนและที่อยู่ที่ติดต่อได้
​    ​     2.3 การแสดงยอดเงินคงเหลือในบัญชีเงินฝากธนาคาร และการวางเงินมัดจำตามยอดรวมประมูลสูงสุดที่ท่านประสงค์จะประมูล

2.4  การวางเงินมัดจำเพื่อแสดงความประสงค์ในการเข้าร่วมประมูล วางเงินมัดจำได้โดย

        2. โอนเงินเข้าบัญชีธนาคาร

        3. สั่งจ่ายเช็คในนามบริษัท บางกอก อาร์ต อ๊อกชั่น เซ็นเตอร์ จำกัด
        4. บัตรเครดิต Visa และ Mastercard โดยจะเปิดรับเฉพาะในวันที่ 18 ธันวาคม 2564 เท่านั้น

การวางเงินมัดจำด้วยเช็ค โอนเงินเข้าบัญชีทางหรือเงินสด ทางบริษัทจะสั่งจ่ายเช็คคืนภายใน 30 ธันวาคม 2564 ด้วยจำนวนหลังหักมูลค่าทรัพย์ประมูลบวกค่าธรรมเนียมประมูล (ถ้ามี)

การวางมัดจำโดยการชำระผ่านบัตรเครดิตจะทำการยกเลิกให้หลังเลิกงาน หากไม่มีทรัพย์ที่ประมูลได้ แต่หากมีทรัพย์ที่ประมูลได้ ต้องชำระค่าทรัพย์ที่ประมูลและค่าธรรมเนียมประมูลก่อน จึงจะทำการยกเลิกเงินมัดจำ แต่หากยังไม่ได้ชำระมูลค่าทรัพย์ในวันประมูล ทางบริษัทจะถือว่าเงินมัดจำคงเหลือหลังหักค่าธรรมเนียมบัตรเครดิต 3% เป็นการชำระทรัพย์ประมูลบางส่วน ตามเงื่อนไขการชำระเงินข้อ 2

ทางบริษัท ขอสงวนสิทธิ์การเข้าร่วมประมูลในมูลค่าผลงานที่ได้แจ้งความประสงค์กับทางบริษัทไว้เท่านั้น และไม่สามารถเปลี่ยนแปลงยอดวงเงินการเข้าร่วมประมูลเมื่อการประมูลได้เริ่มต้น

การลงทะเบียนเข้าร่วมประมูลจะสำเร็จสมบูรณ์ เมื่อทางบริษัท ได้รับหลักฐานตามเงื่อนไขครบถ้วนและได้มีการยืนยันกลับจากทางบริษัท

การชำระเงิน

1. สำหรับผู้ประมูลในห้องประมูล (ผู้ที่ประมูลด้วยตนเอง) ผู้ประมูลผ่านทางโทรศัพท์ และผู้ฝากประมูลล่วงหน้า การชำระราคา ผู้ชนะการประมูลต้องจ่ายค่า ธรรมเนียมการประมูลในอัตรา 15% (บวกภาษีมูลค่าเพิ่ม 7%) ของมูลค่าที่ประมูลได้
2. การชำระเงินและเงื่อนไขการชำระมีดังต่อไปนี้
   1. การชำระเงินและการรับสินค้าต้องเสร็จสิ้นภายใน 5 วันทำการ นับจากวันที่หลังการประมูล (24 ธันวาคม 2564)
      – เงินสด
      – โอนเงินเข้าบัญชีธนาคาร ตามรายละเอียดดังนี้
      ชื่อบัญชี บริษัท บางกอก อาร์ต อ๊อกชั่น เซ็นเตอร์ จำกัด
      ธนาคาร ไทยพาณิชย์ สาขาตลาดน้อย เลขที่บัญชี 013-408874-2
      – บัตรเครดิต การชำระด้วยบัตรเครดิตของ Master Card และ Visa จะต้องชำระเพิ่ม 3% สำหรับค่าธรรมเนียมบัตรเครดิต
      – ชำระด้วยเช็ค โดยสั่งจ่ายในนาม บริษัท บางกอก อาร์ต อ๊อกชั่น เซ็นเตอร์ จำกัด การชำระเงินจะสมบูรณ์เมื่อธนาคารสามารถเรียกเก็บเงินได้ครบ ตามจำนวนเงิน 100 % เท่านั้น
   2. เงินมัดจำการประมูล จะถูกนำมาชำระค่าทรัพย์ประมูลโดยอัตโนมัติ หากมียอดคงค้าง ผู้ชนะการประมูลต้องดำเนินการชำระให้ครบถ้วนภายในวันที่ กำหนด มิฉะนั้นทางบริษัทขอสงวนสิทธิในการยึดเงินมัดจำดังกล่าว
   3. ในกรณีที่บริษัทไม่สามารถเรียกเก็บเงินได้ครบถ้วนตามมูลค่าที่ประมูลได้ภายในวันที่กำหนด ทางบริษัท ขอสงวนสิทธิ์ในการเสนอทรัพย์ประมูลนั้น แก่ผู้ที่ชนะการประมูลลำดับรองลงมา และจะเป็นการตกลงระหว่าง ผู้ชนะการประมูลลำดับรองลงมา เจ้าของทรัพย์ที่ฝากประมูล และบริษัทเท่านั้น
   4. ผู้ชนะการประมูลจะสามารถรับสินค้าได้ เมื่อการชำระเงินสมบูรณ์เรียบร้อยแล้วเท่านั้น ในกรณีที่ผู้ชนะการประมูล ไม่แสดงความประสงค์ที่จะรับ ทรัพย์ประมูลภายในเวลาที่กำหนด ทางบริษัท ขอสงวนสิทธิ์ในการคิดค่าใช้จ่ายในการดูแลรักษาทรัพย์ประมูล วันละ 1,000 บาทต่อผลงานหนึ่งชิ้น โดยนับจากวันที่พ้นกำหนดการรับสินค้า
   5. ในกรณีที่ผู้ชนะการประมูล ดำเนินการชำระเงินครบตามจำนวนเป็นที่เรียบร้อย แต่ไม่ติดต่อกับบริษัทเพื่อ มารับทรัพย์ที่ประมูลได้ ภายในระยะเวลา 3 เดือนนับจากวันที่ประมูล ทรัพย์ประมูลดังกล่าว จะตกผู้ภายใต้กรรมสิทธิ์ขของบริษัทโดยสิ้นเชิง โดยผู้ประมูลไม่สามารถเรียกร้องค่าเสียหาย หรือเงินชดเชยใดๆ จากบริษัทได้

การขนส่ง

1. ผู้ชนะการประมูลจะเป็นผู้รับผิดชอบในการบรรจุหีบห่อและขนสินค้าออกจากที่ทำการบริษัทฯ โดยทางบริษัทจะให้ข้อมูลบริษัทขนส่ง เพื่ออำนวย ความสะดวกต่อผู้ประมูลเท่านั้น ไม่ได้หมายรวมถึงความรับผิดชอบใดๆ ของบริษัทในส่วนนี้
2. ถ้ามีความประสงค์จะนำทรัพย์ประมูลออกนอกประเทศ ผู้ชนะการประมูลจะเป็นผู้รับผิดชอบในการดำเนินกรรมวิธีตามระเบียบปฏิบัติของทาง ราชการในการนำสินค้าออกนอกประเทศด้วยตนเอง

ข้อความข้างต้นนี้ เป็นเพียงแนวทางสำหรับผู้ที่จะเข้าร่วมประมูลเท่านั้น บริษัท บางกอก อาร์ต อ๊อกชั่น เซ็นเตอร์ จำกัด ขอสงวนสิทธิ์ในการตีความ และตัดสินในกรณีต่าง ๆ อันอาจจะเกิดขึ้น
